These Terms of Service ("Terms") govern your use of Foamy Frothers services, including surf lessons, coaching sessions, programs, events, and any related activities (collectively, the "Services"). By booking, participating in, or using our Services, you agree to be bound by these Terms.

1. About Us

Foamy Frothers provides surf coaching, ocean-based experiences, and wellbeing-focused activities designed to support confidence, connection, and mental wellbeing through surfing.

2. Eligibility & Participation

  • Participants must be physically and mentally capable of taking part in ocean-based activities.

  • Participants under the age of 18 must have consent from a parent or legal guardian.

  • You agree to follow all instructions provided by Foamy Frothers coaches and staff at all times.

3. Health & Safety Acknowledgement

Surfing and ocean activities involve inherent risks, including but not limited to waves, currents, weather conditions, marine life, and physical exertion.

By participating, you acknowledge and agree that:

  • You understand the risks involved in surfing and ocean environments.

  • You participate voluntarily and at your own risk.

  • Foamy Frothers is not responsible for injuries, accidents, loss, or damage except where required by law.

Participants are responsible for informing Foamy Frothers of any relevant medical conditions, injuries, or limitations prior to participation.

4. Mental Wellbeing Disclaimer

Foamy Frothers incorporates mindfulness and wellbeing principles into its sessions. These Services:

  • Are not a substitute for medical, psychological, or psychiatric care.

  • Do not provide diagnosis, treatment, or professional mental health services.

If you have serious mental health concerns, we strongly encourage you to seek support from a qualified healthcare professional.

5. Bookings & Payments

  • All bookings are subject to availability.

  • Prices are displayed in NZD unless stated otherwise.

  • Payment must be made in full prior to the session unless otherwise agreed.

  • Foamy Frothers reserves the right to refuse or cancel bookings at its discretion.

6. Cancellations & Refunds

  • Cancellations made more than 48 hours before a session may be eligible for rescheduling or a refund.

  • Cancellations within 48 hours may not be refunded.

  • Foamy Frothers may cancel or reschedule sessions due to weather, ocean conditions, safety concerns, or unforeseen circumstances. In such cases, you will be offered a reschedule or refund.

7. Equipment Use

  • Any equipment provided (including surfboards and wetsuits) must be used responsibly.

  • You may be liable for loss or damage caused by misuse or negligence.

8. Photography & Media

Foamy Frothers may take photos or videos during sessions for promotional or educational purposes. By participating, you consent to the use of such media unless you notify us in writing prior to the session.

Photos or videos taken during sessions may be used for marketing or media for promotion of business.

9. Code of Conduct

Participants must:

  • Treat others with respect.

  • Follow safety instructions at all times.

  • Refrain from aggressive, reckless, or inappropriate behaviour.

Foamy Frothers reserves the right to remove any participant who does not comply with this code, without refund.

10. Liability Limitation

To the maximum extent permitted by New Zealand law:

  • Foamy Frothers is not liable for indirect or consequential loss.

  • Liability is limited to the amount paid for the Services.

  • Nothing in these Terms limits rights under the Consumer Guarantees Act 1993 where applicable.

11. Privacy

Personal information is handled in accordance with New Zealand privacy laws. Information collected is used solely for booking, communication, and service delivery purposes.

12. Changes to These Terms

Foamy Frothers may update these Terms from time to time. The latest version will be available on our website and will apply to all future bookings.

13. Governing Law

These Terms are governed by the laws of New Zealand.
